The placement of sediment on agricultural land (pursuant to Decree 257/2009).

Sediment analysis pursuant to Decree 257/2009, on the use of sediments on agricultural land.

The decree determines limits both for sediment and for the soil on which it is to be placed.

  • Sediment analysis (Annex 1)
  • Agricultural soil analysis (Annex 3)

Ideally (but rarely) the sediment meets both the limits for sediment (Annex 1) and also the limits for agricultural land (Annex 3), meaning a sediment analysis is sufficient for its placement.

Backfilling (pursuant to Decree 273/2021)
  • Pursuant to Decree 273/2021, on the details of waste management, table 5.4
  • Where the sediment does not comply with Table 5.4 in no more than three parameters, ecotoxicity tests may be performed pursuant to Table 5.3 of Decree 273/2021. Where the sediment complies with these limits, it can be used for backfilling.

Determines:

  • Physical parameters – skeleton 2-4 mm, skeleton >4 mm, particulate <0.01 mm
  • Inorganic parameters – total nitrogen, ammoniacal nitrogen, nitrate nitrogen, metals (Ca, Mg, K, P, As, Be, Cd, Co, Cr, Cu, Hg, Ni, Pb, V, Zn)
  • Organic parameters – BTEX, polycyclic aromatic hydrocarbons, polychlorinated biphenyls, C10-C40 hydrocarbons, DDT – sum of 6 isomers
  • If possible contamination is suspected
  • Microbiological and biological parameters - thermotolerant coliform bacteria, enterococci, Salmonella spp.
  • Toxicity test on white worms (Enchytraeus crypticus), toxicity test on springtail (Folsomia candida), nitrification inhibition, inhibition of growth of higher plants (Lactuca sativa)

Analysis duration: usually seven to ten business days

Additional information:

  • As a rule, the cheapest yet legislatively most demanding solution, is to place the sediment on nearby agricultural land, as it will also add nutrients
  • As a rule, use for backfilling is the simplest in terms of administration
  • It is possible to perform an analysis for use on the agricultural land fund and supplement it with several parameters from surface backfilling, and to make a decision only when the results are available (the scope of analyses is analogous). This is environmentally friendly and protects natural resources
  • Landfilling is the least advantageous (the sediment is polluted, and so a landfilling fee is applied). This is the emergency option when no other option is possible.
